How to become an affiliate of EverestGear.com:

1.) Read the terms and conditions below and fill in the required information

2.) You will receive an email from us confirming receipt of your application. Get some cool banners and link to us.

3.) After we review, and if approved, we will email you a confirmation

4.) You will start receiving quarterly payments from us once you earn $50 in commission and submit the W9 form according to the terms and conditions below.

5.) Note: 10% commissions on books, maps, gear and videos!!!

Terms and conditions

By applying to become an affiliate of EverestGear.com you agree to the following terms and conditions:

1. You will receive 10% (ten percent) of the merchandise amount (does not include shipping or tax) that was purchased from EverestGear.com by a visitor who came to the EverestGear.com site through the link on your site and has made a purchase as a result of this visit.
2. In a case of a return and/or cancellation of an order, which was received through the link to your site, the commission of this order will be deducted from the total amount owed you for the payment period.
3. EverestGear.com reserves the right to decline acceptance of any or all applications to join its affiliate program.
4. By filling out and submitting your application, you agree to all terms of this agreement including not to:
   1. Mislead others
   2. Operate or utilize a Web site or email link to Web sites that contain or promote any of these types of content: libelous, defamatory, obscene, pornographic, abusive, violent, bigoted, hate-oriented, illegal, cracking, hacking, or that offer any illegal good or service, or link to a Web site(s) that do so and/or
   3. Engage in spamming, indiscriminate advertising or unsolicited commercial email
   4. Engage in cyber squatting or typo squatting.
5. Approved affiliates are NOT allowed to transfer their affiliate status to other individuals or websites without the written (email) approval of EverestGear.com.
6. Both EverestGear.com and affiliate may terminate this agreement with no reason and at any time with an advanced notice of 24 hours. Notification will be done by email.
7. Upon notice of termination of the affiliation program by EverestGear.com, the affiliate agrees to remove all icons, banners and or text related to EverestGear.com, as well as remove any or all links to the EverestGear.com website.
8. You must be over 18 years of age.
9. Merchandise is defined for this agreement as books, maps, videos only. Note we currently ship US and Canada orders only.
10. Each EverestGear.com affiliate remains solely responsible for its website.
11. You may display the promotional materials only on the Affiliate Web Site approved by EverestGear.com.
12. The Affiliate shall be solely responsible for the design, programming, hosting, content, maintenance, accessibility, and appearance of the Affiliate Web Site.
13. The Affiliate shall defend EverestGear.com and its affiliated and related entities and hold them harmless against any and all claims, demands, losses, damages, or injuries (including, but not limited to, costs and attorneys’ fees) they incur arising out of or relating to any action or omission of the affiliated, regardless of whether such action or omission is within or outside of the scope of this Agreement.
14. EverestGear.com may modify any of the terms and conditions in the Agreement, and/or any of our policies and operating procedures at any time and from time to time, in our sole discretion. You will be notified by email of any modification to the terms and conditions to this Agreement and a change notice will be posted on this page. If the modification is not acceptable to you, you may terminate your continued participation in the Affiliate Program. Your continued participation in the Affiliate Program after modifications to the Affiliate Program are made constitutes your acceptance of the modifications.
15. The promotional materials and any other materials provided by EverestGear.com pursuant to this Agreement are provided “as is”. EverestGear.com, including its related and associated companies and everestgear.com web sites, disclaim all warranties, whether express, implied or statutory, including without limitation the implied warranties of title, merchantability, fitness for a particular purpose and non-infringement.
16. EverestGear.com, including its related and affiliated companies and all EverestGear.com properties, disclaim all compensatory, consequential, incidental or special damages or lost profits arising out of or in connection with this agreement. The total amount of damages that are available to you from the EverestGear.com, its related and affiliated companies, and all EverestGear.com Properties, in the event of any loss, claim or damage, shall not exceed $200 (two hundred dollars).
17. Publicity. Affiliate shall not issue any press release nor make any public statement regarding this Agreement (including the terms and existence thereof) or the relationship of the parties without the EverestGear.com prior written approval which may be withheld in EverestGear.com’s sole discretion.
18. Confidentiality. The Affiliate shall use its reasonable effort to keep confidential the terms and conditions of the Agreement and all information regarding the customers who click on the promotional materials.
19. Relationship of the parties. The relationship of the Affiliate to the EverestGear.com shall be that of an independent contractor. Nothing in this Agreement shall be construed to create a partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.
20. Choice of law and forum; identification of parties. This Agreement shall be governed by the law of the State of Ohio. Any dispute arising under or relating to this Agreement shall be resolved in a state or federal court in Ohio. Affiliate agrees that the EverestGear.com shall be the only party named by the Affiliate in any dispute arising under or relating to this Agreement. The Affiliate hereby consents to personal jurisdiction in any state or federal court in Ohio for any claims arising from or relating to this Agreement.

This Agreement contains the entire understanding and agreement between the parties hereto.
